Controversial Milwaukee County Sheriff David Clarke, who this week announced he will be joining Donald Trump’s administration as assistant secretary in the Department of Homeland Security, plagiarized sections of his 2013 master’s thesis on US security, a CNN KFile review has found.

Clarke, a visible surrogate for Trump during the campaign known for his incendiary rhetoric, earned a master’s degree in security studies at the Naval Postgraduate School in Monterey, California. In his thesis, “Making U.S. security and privacy rights compatible,” Clarke failed to properly attribute his sources at least 47 times.

The defendants are right that Clarke’s posts do not amount to a “campaign” of harassment like what was described in Bart and Wallace, where the defendants repeatedly tormented the plaintiffs with petty reprimands and ridicule.And Clarke’s posts are not profoundly humiliating to Black in the way that the sheriff’s public statements were to the plaintiff rape victim in Bloch.

But Clarke’s posts could reasonably be understood as a “threat, coercion, or intimidation that punishment. . .will immediately follow.” Novoselsky, 822 F.3d at 356. They say as much on their face, and in aggressive and combative language. Cf. Fairley, 578 F.3d at 520 (defendant’s comment implying plaintiff officers deserved to be stabbed was sufficiently threatening to state a claim). Of course, another interpretation is that the posts are intentionally hyperbolic (and juvenile) attempts at mockery and self-promotion, and that an ordinary person would not be intimidated by them.

Clarke abruptly resigned as sheriff in August after nearly 16 years to take a job with the pro-Donald Trump super PAC America First Action as a spokesman and senior adviser.

He also created a new company called DAC Enterprises, based in Maryland, and is working for two conservative think tanks, the Capital Research Center and America First Action Policy.

This week, Clarke has been in the news for his conspiracy theory that the children who survived the brutal Parkland, Fla., school shooting last week are actually operatives of liberal billionaire George Soros
